Terms (DRAFT)

HeadRep by [Company Legal Name] · Effective [date] · Draft for counsel review, not legal advice.

This document has three parts:

Part A: Terms of Service

A1. The deal

By creating an account, buying a subscription or buying a team license, you agree to these Terms and our Privacy Policy. If you're 13 to 17, a parent or guardian must agree to these Terms for you [counsel: confirm the parental co-acceptance mechanism], and you also agree to the Teen Terms in Part B. If you're 10 to 12, your parent or guardian accepts these Terms and the Kids' Terms (Part C) for you.

A2. What HeadRep is, and isn't

HeadRep offers mental-performance training: visualization, breathing, goal setting, declarations and educational content for athletes. It is not medical care, therapy, counseling or a crisis service, and it doesn't diagnose or treat any condition. Content from athletes, coaches and creators is educational and inspirational, not professional advice. If you're in crisis, call 988 or 911.

A3. Eligibility

A4. Accounts

Keep your sign-in secure. You're responsible for activity on your account. Tell us at [support@domain] if you think it's been compromised.

A5. Subscriptions (individual)

A6. Team licenses

A7. Acceptable use

Don't misuse the service: no hacking or reverse engineering, no scraping, no impersonation, no gaming the points system with automation, and no using the app to harass anyone.

A8. Points, streaks and rewards

Points, streaks, levels and unlocks have no cash value, can't be transferred, and may be adjusted to fix errors or abuse. You can turn points and streaks off anytime.

A9. AI features

AI features (like the AI Goals Coach) generate suggestions that may be inaccurate. Use your own judgment. You're always told when you're interacting with AI.

A10. Your content

You own what you write and record. You give us a limited license to store and process it only to provide the service to you. Most of it stays on your device and we never see it.

A11. Our content

Exercises, scripts, audio, lessons and the app are owned by us or our licensors, including athletes and creators. Personal, non-commercial use only.

A12. Changes and ending

We may update the service and these Terms, with in-app notice of material changes. You can delete your account anytime (Profile → Account → Delete my account). A parent can delete a 10 to 12 child's account from Parent controls. We may suspend accounts that break these Terms.

A13. Disclaimers and limits

[Standard warranty disclaimer and limitation of liability; counsel to tailor for a mental-performance product used by minors.]

A14. Disputes

[Governing law (e.g., Colorado), venue, informal resolution first. Counsel to decide on arbitration or a class waiver for minors.]

Part B: Teen Terms of Use (ages 13–17)

Hey, here's the deal, straight up:

  1. This is training, not therapy. We help you build mental skills for your sport. If things get really hard, tap Need help now? That's 988 (the Suicide & Crisis Lifeline), 911, or someone you trust. Real people are there 24/7.
  2. Your private stuff stays yours. Your journal, debriefs, recordings and check-in answers stay on your phone. Coaches, teammates and parents can't see them.
  3. Teammates see your first name, your team and your weekly points on the team board. That's it, and you can hide from the board anytime.
  4. The AI coach is AI. It can be wrong. You decide what to keep.
  5. Points and streaks are optional. Turn them off anytime. They're for fun and have no cash value.
  6. Be decent. Don't cheat the points system, don't try to break the app, don't use it to mess with anyone.
  7. You can see what we store and delete everything in Profile.
  8. You're 13 or older. If you're 10 to 12, a parent has to say yes first (Part C). HeadRep isn't for anyone under 10.

A parent or guardian also agrees to our full Terms (Part A) for you. [Counsel: confirm.]

Part C: Kids' Terms of Use (ages 10 to 12)

Shown to the athlete after a parent has consented. Your parent agreed to the full Terms for you.

  1. This is training for your mind, not a doctor or a counselor. If something feels like too much, tell a parent, a coach or another adult you trust. You can also call or text 988 anytime. In an emergency, call 911.
  2. Your parent said yes, and your parent is in charge. They chose whether teammates can see your name and whether you get points and streaks. They can change that or delete your account anytime.
  3. Your private stuff stays on your phone. Your journal, debriefs, recordings and check-in answers stay on your phone. We can't see them, and neither can your coach or teammates.
  4. No chatting, no strangers. HeadRep has no messages, comments or public profiles. Nobody can contact you through it.
  5. Be fair. Don't cheat the points system or try to break the app.
  6. Points are just for fun. They aren't money and can't be traded.
